User Terms and Conditions

    General

  1. These terms and conditions for the use of the ECA Fixture Hub (the “Terms”) apply if you (the “User”) have been given access to the ECA Fixture Hub (the “Service”) by the European Club Association (“ECA”).
  2. By using the Service, you agree to comply with and be bound by these Terms which set out the rights and obligations of all parties relating to the Service. If you do not agree with any element of these Terms, you may not access the Service.
  3. Your access to and use of the Service is also conditioned on your acceptance of and compliance with the ECA Privacy Policy. Our Privacy Policy describes our policies and procedures relating to the collection, use and disclosure of your personal information when you use the Service. Please read our Privacy Policy carefully before using the Service.
  4. These Terms apply between you (the User) and ECA only and no rights, obligations or liabilities are owed by or to any third parties (including LCP as defined below).
  5. The Service

  6. The Service:
    1. is a software-as-a-service tool, accessible from most web browsers and is also usable as a web application, accessible at www.ecafixturehub.com;
    2. facilitates communication between Users for the purposes of arranging football matches;
    3. is only available to Users that are approved by ECA;
    4. has been developed in a collaboration between ECA and Lane Clark & Peacock LLP (“LCP”) (a limited liability partnership registered in England and Wales with registered number OC301436 and VAT number 258 3638 73);
    5. is owned and made available to Users by ECA, subject to 1(f) below;
    6. contains information, intellectual property and data from TransferLab™ (an advanced online data-scouting platform) owned and operated by LCP, for the purposes of using analytics (the “TransferLab Data”) to provide Users with an indication of the strength of potential opponents;
    7. allows Users to enter a limited amount of user-inputted data (including personal data) which becomes accessible to other Users in limited circumstances;
    8. May contain links to third-party web sites or services that are not owned or controlled by ECA or LCP. In such circumstances, ECA and LCP assume no responsibility for the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that ECA and LCP shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

    User Obligations

  7. As a User, you undertake not to:
    1. Copy, reproduce, publish, distribute, redistribute, broadcast, transmit, modify, adapt, edit, abstract, store, archive, display publicly or to third parties, sell, resell, license, lease, rent, assign, transfer, disclose or in any way commercially exploit any part of the Service;
    2. Permit any use or access of the Service in any manner by any third party;
    3. Combine, merge, or otherwise permit any part of the Service to become incorporated in any other program or service, or arranging or creating any derivative works based on the Service or any part of it;
    4. Modify, make derivative works of, decompile, reverse engineer, disassemble, reproduce, republish, or copy the Service or any part of the Service;
    5. Use the Service in a way that breaches any applicable laws, or promotes or condones hate, violence, or discrimination;
    6. Use any intellectual property owned by ECA or LCP (including, but not limited to names such as “ECA”, “LCP”, “Fixture Hub”, and “TransferLab” together with the respective logos, trademarks and other brand indicators owned by ECA or LCP) without express, prior, written approval;
    7. Upload to the Service any data, information or materials which infringe on the intellectual property rights of others;
    8. Upload, post, disseminate or otherwise transmit within the Service any material or language that is abusive, obscene, pornographic, bullying, defamatory, harassing, grossly offensive, vulgar, threatening, or malicious or that would encourage any conduct constituting a criminal offence or promote or incite violence;
    9. Upload, post, disseminate or otherwise transmit any material that contains software viruses, harmful materials, or any other computer code, files or programs designed to interrupt, destroy, or limit the functionality of any computer software (including the Service) or hardware or telecommunications equipment;
    10. Promote or provide instructional information about any illegal activities within the Service;
    11. Interfere with or disrupt the Service or ECA’s website, or disobey and requirements, procedures, or policies or regulations of networks connected to the Service;
    12. Use the Service for any illegal or immoral purpose or in any way that might bring the reputation of ECA, LCP or any other User into disrepute;
    13. Impersonate other people whilst using the Service;
    14. Commit any criminal offence in relation to the Service including attempting to gain unauthorised access to any part of the Service, other User accounts, computer systems or networks through hacking, password mining or any other means;
    15. Use the Service for streaming videos, supplying links to third party websites, or mass communications such as junk mail, unless authorised by ECA;
    16. Use the TransferLab Data:
      1. for any purpose other than to assist with your use of the Service to organise football matches with other Users;
      2. to create your own tables, databases, or compilations of data other than as is necessary to use the Service for the purposes of organising football matches with other Users;
      3. in any way that captures, edits, alters, amends, or otherwise interferes with the TransferLab Data;
      4. in any way that copies or reproduces the TransferLab Data to any other server or location for further reproduction or redistribution; or
      5. in any way that decompiles, disassembles, reverse engineers or otherwise attempts to ascertain any source code contained in the TransferLab Data.
  8. As a User of the Service, you acknowledge and agree that:
    1. any rights (including any intellectual property rights) in the Service are owned by ECA, subject to 3(b) below;
    2. any rights (including any intellectual property rights) in the TransferLab Data are owned by LCP and its collaborators or licensors;
    3. any data you enter into the Service will be available to ECA and LCP, with the ability to view, update, remove and process that data for the purpose of maintaining the system;
    4. some limited personal data (your name and contact details) will be made available to other Users solely in the event that you commence communications with another User for the purposes of arranging a football match;
    5. you may receive email notifications from the Service including but not limited to password resets, operational notifications from ECA and/or LCP, communications necessary to resolve any complaints/bugs/software issues, and notifications regarding communications received by other Users within the Service;
    6. ECA operates a fair usage policy across the Service and accordingly may need to prevent Users from excessive usage including communication volumes with other Users;
    7. you are responsible for ensuring that all passwords and login details are kept strictly confidential. Login details must not be shared by Users to any third parties;
    8. the Service is provided to you “as is” and “as available” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, ECA, on its own behalf and on behalf of LCP, expressly disclaims all warranties, whether express, implied, statutory, or otherwise, with respect to the Service including all implied warranties of fitness for a particular purpose and non-infringement of third party intellectual property rights. You further acknowledge that ECA provides no warranty or undertaking that the Service will meet your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

    Termination and Liability

  9. Failure to comply with any element of these Terms may result in your use of the Service being suspended or terminated immediately (without prior notice or liability) and any content uploaded by you in breach of these Terms will be removed by ECA, LCP or their agents. In such circumstances, you may not be permitted to regain access to previous communications or information received or supplied by you within the Service.
  10. Notwithstanding any damages that you might incur, the entire liability of ECA and any of its suppliers under any provision of these Terms and your exclusive remedy for all of the foregoing shall be limited to 100 CHF.
  11. To the maximum extent permitted by applicable law, in no event shall ECA or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of these Terms), even if ECA or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.
  12. Modification and Revision

  13. We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Service after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, in whole or in part, you must stop using the Service.
  14. Governing Law

  15. The laws of Switzerland shall govern these Terms. If you are a European Union-based User, you may benefit from any mandatory provisions of the law of the country in which you are resident in.
